BISMA Terms and Conditions

1. Introduction

1.1 These Terms and Conditions form the legally binding contract between you (“the learner”) and British International Sports Medicine Academy (BISMA).

1.2 BISMA is a training provider delivering:
(a) UK-regulated qualifications issued by UK-regulated awarding organisations; and
(b) Non-regulated qualifications and CPD courses issued internally by BISMA.

1.3 BISMA delivers training through face-to-face venues, online platforms, distance learning, and blended delivery models.

1.4 By enrolling on a BISMA course, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

3. Policies and Procedures (Contractual Incorporation)

3.1 By enrolling on a BISMA course, learners agree to comply with all BISMA policies and procedures, including but not limited to:

4. Enrolment, Eligibility and Acceptance

4.1 Learners must be at least 16 years old and have the legal right to study in the UK.

4.2 BISMA reserves the right to request additional information to assess a learner’s suitability, including medical or fitness-related information where relevant to course safety.

4.3 BISMA may refuse or discontinue an application or course in accordance with its published policies and procedures, including where concerns relating to learner conduct, safety, safeguarding, non-payment, or suitability arise.

4.4 Acceptance onto a course is confirmed only once enrolment is approved and payment arrangements are in place.

5. Fees and Payment

5.1 Learners are responsible for paying all course fees in full, whether paid upfront or by instalments.

5.2 Access to course materials may be suspended, certification withheld, or services paused where payments are overdue or incomplete.

5.3 Where a third party pays fees on behalf of a learner, the learner remains responsible for compliance with these Terms and Conditions.

6. Course Delivery and Changes

6.1 BISMA reserves the right to amend course dates, venues, delivery methods, or tutors where reasonably necessary.

6.2 Where BISMA is unable to deliver a scheduled session, an alternative session will be offered. BISMA is not responsible for travel costs, accommodation, or loss of earnings.

6.3 Advertised course timelines are indicative only and may vary depending on assessment requirements and learner progress.

7. Learner Conduct, Discipline and Exclusion

7.1 Learners are expected to comply with BISMA policies, instructions, health and safety requirements, and reasonable directions from staff.

7.2 Breach of BISMA policies may result in disciplinary action, including suspension or permanent exclusion, in accordance with the Learner Sanctions, Disciplinary & Exclusion Policy.

7.3 Where a learner is suspended or excluded for disciplinary reasons, this does not automatically entitle the learner to a refund.

8. Appeals and Complaints

8.1 Learners may submit an appeal on procedural grounds only, in accordance with the Learner Sanctions, Disciplinary & Exclusion Policy.

8.2 Complaints unrelated to disciplinary sanctions may be raised under the Learner Complaints Policy.

8.3 Awarding organisations do not adjudicate or overturn centre disciplinary or exclusion decisions, but may review whether BISMA has followed its approved policies and procedures where relevant to regulatory compliance.

9. Withdrawal, Cancellation and Refunds

9.1 Learners have a statutory 14-day cancellation right only where applicable under consumer law, and only where:
(a) the course has not started; and
(b) access to digital course materials has not been provided.

9.2 By enrolling and accessing course materials, learners expressly request BISMA’s services to begin immediately and acknowledge that this affects statutory cancellation rights in accordance with consumer legislation. I confirm that I consent to the immediate start of my course and understand that by accessing course materials I waive my statutory 14-day cancellation rights.

9.3 Refunds are not available once a course has started or where access to digital content has been granted, except where required by law.

9.4 Refunds may be considered where a learner is medically unfit to participate, subject to appropriate evidence and BISMA approval.

10. Distance Learning

10.1 Distance learners must have appropriate internet access and equipment.

10.2 Access to online learning platforms constitutes commencement of services.

10.3 No refunds are available once access to distance learning materials has been provided, except where required by law.

11. Certification

11.1 Certificates will only be issued once:
(a) all course and assessment requirements have been met; and
(b) all course fees have been paid in full.

11.2 BISMA may issue completion letters at its discretion where payments are up to date.

12. Course Materials and Intellectual Property

12.1 All course materials, including digital content, documents, videos, assessments, and resources, are provided for the learner’s personal use only.

12.2 Course materials must not be copied, shared, distributed, recorded, reproduced, or used for commercial purposes without BISMA’s prior written consent.

13. Transfer of Enrolment

13.1 Enrolment is personal to the learner and may not be transferred, assigned, or sold to another person without BISMA’s prior written consent.

14. Data Protection

14.1 BISMA processes personal data in accordance with applicable data-protection legislation, including the UK GDPR and Data Protection Act 2018.

15. Limitation of Liability

15.1 BISMA is not liable for indirect or consequential losses, including loss of earnings, accommodation costs, travel expenses, or any other losses.

15.2 Nothing in these Terms limits BISMA’s liability where such limitation is prohibited by law.

16. Events Outside Our Control (Force Majeure)

16.1 BISMA shall not be liable for any failure or delay in the performance of its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to venue closures, utility failures, government restrictions, or other unforeseen circumstances.

17. Changes to These Terms

17.1 BISMA may update these Terms and Conditions from time to time.

17.2 The version of the Terms and Conditions in force at the time of enrolment will apply to that enrolment.

18. Severability

18.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

19. Governing Law and Jurisdiction

19.1 These Terms and Conditions are governed by the laws of England and Wales.

19.2 Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

20. Entire Agreement

20.1 These Terms and Conditions, together with BISMA’s published policies and procedures, constitute the entire agreement between the learner and BISMA.

20.2 The learner confirms that they have not relied on any statement, representation, assurance, or promise not expressly set out in these Terms or BISMA’s published policies.
