BISMA Whistleblowing Policy
Introduction
This whistleblowing policy outlines the commitment of BISMA to maintain an open and transparent culture where employees, learners, and others feel confident in raising concerns about wrongdoing, misconduct, or unethical behaviour. This policy is in line with UK legislation and aims to protect those who report concerns in good faith.
Scope
This policy applies to all teachers, learners, contractors, and others associated with BISMA. It covers all activities and services provided by BISMA, including educational courses, administrative functions, and any other programmes or activities conducted by our Centre.
Objectives
To encourage and enable individuals to raise concerns about wrongdoing without fear of retaliation.
To ensure that concerns are investigated promptly and thoroughly.
To protect whistleblowers from reprisal or victimisation.
To promote a culture of openness, accountability, and integrity within BISMA.
Definitions
Whistleblowing: The act of reporting concerns about wrongdoing, misconduct, or unethical behaviour within our Centre.
Wrongdoing: Includes but is not limited to fraud, corruption, health and safety violations, environmental damage, abuse of authority, and other unethical or illegal activities.
Whistleblower: An individual who raises a concern about wrongdoing within the Centre.
Key Principles
Confidentiality: All concerns will be treated in strict confidence, and the identity of the whistleblower will be protected unless disclosure is required by law.
Protection: Whistleblowers will be protected from reprisal or victimisation as a result of raising a concern.
Impartiality: All concerns will be investigated impartially and without bias.
Support: Support will be provided to whistleblowers throughout the process.
Raising a Concern
Internal Reporting: Concerns should be raised with the designated Whistleblowing Officer.
External Reporting: If internal reporting is not possible or the whistleblower feels the concern has not been addressed, they may report to external authorities such as the Awarding Body, Health and Safety Executive, or other relevant regulatory bodies.
Reporting Procedures
Initial Report: Concerns should be reported in writing, providing as much detail as possible, including any evidence to support the concern.
Investigation: The Whistleblowing Officer will acknowledge receipt of the concern within five working days and initiate an investigation. The investigation process may involve interviews, document reviews, and collaboration with other departments or external bodies.
Outcome: The whistleblower will be informed of the outcome of the investigation, subject to legal and confidentiality constraints. If wrongdoing is confirmed, appropriate action will be taken to address the issue and prevent recurrence.
Protection and Support for Whistleblowers
Protection from Retaliation: BISMA will not tolerate any form of retaliation or victimisation against whistleblowers. Anyone found to be engaging in such behaviour will face disciplinary action.
Confidential Advice: Whistleblowers can seek confidential advice and support from the Human Resources department or an independent advisor.
Counselling Services: Access to counselling services will be provided to whistleblowers if required.
Responsibilities
Whistleblowing Officer: Responsible for managing the whistleblowing process, ensuring concerns are investigated, and protecting whistleblowers from retaliation.
Senior Management: Responsible for fostering a culture of openness and integrity, ensuring the policy is implemented effectively, and supporting the whistleblowing process.
All Staff and Learners: Responsible for understanding and adhering to the whistleblowing policy and for reporting any concerns about wrongdoing.
Review and Monitoring
Policy Review: This whistleblowing policy will be reviewed annually, or sooner if required, to ensure it remains current and effective.
Monitoring: The implementation of the policy will be monitored through regular audits, feedback from stakeholders, and analysis of whistleblowing incidents and outcomes.
